Agnes, the local busybody in a small town, likes causing mischief. Beavis runs a respectable house-painting business in the same small town. While looking for his client’s home, Beavis spots Agnes on the sidewalk and asks her for directions. Agnes would love to help. After hearing Beavis’ confusion about finding the correct address, Agnes thinks it would be funny if she told him that the correct address was her neighbor Wanda’s house. Agnes knew that Wanda, her husband, and their two children were on vacation on the other side of town for a few days and would not be home until after Beavis finished painting the house. Agnes thought it would hysterical for Beavis to paint Wanda’s house and then figure out who would pay the bill. Beavis thanks her for the help and mistakenly starts to paint Wanda’s house.
Two days later, Wanda and her family come home to a beautifully painted home and a bill from Beavis for his painting services on their doorstep.
Part 1 (5 points): Was a contract formed between Beavis and Wanda? Be sure to analyze this question using the three contract requirements discussed in this unit.
Part 2 (5 points): Beavis wants to be compensated for the work he performed and the materials that he used to the paint the house. Based on materials from this unit, what legal theory discussed in this unit should Beavis use to recover for the work performed and materials used?
Part 3 (5 points): Based on the type of work performed by Beavis, what is the source of law (UCC or Common Law) that will resolve this dispute? Explain your answer.
Part 4 (10 points): Based on your answer to Part 1, will Beavis be able to satisfy all of the elements for the legal theory you identified in Part 1? Using the information in this problem, explain whether each element is met.
Part 5 (10 points): Suppose that instead of telling Beavis that Wanda’s home was the correct address, Agnes tells Beavis that her house is the correct address. When Beavis knocks on her door prior to beginning work, Agnes sneaks out the backdoor and allows Beavis to paint her house. After Beavis is done later that day, he presents the bill to Agnes but she refuses to pay because she claims she did not want her house painted. Agnes actually loves the new paint job. Using the same theory you identified in Part 1, will Beavis be able to satisfy the elements? What is the difference between this example and the facts as originally presented?
